COP 28 at Expo City Dubai

These Visitor Terms, Conditions and Rules set out the terms, conditions and rules for :

  

(i.) use of Tickets to attend COP28 at Expo City Dubai

 

(hereinafter the "Terms and Conditions").



Introduction

Please read these Terms and Conditions carefully before using the Website owned and operated by

COP28. Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Website. By accessing or using the Website, you agree to comply with and be bound by these Terms and Conditions, which together with COP28 privacy policy govern COP28’s relationship with you in relation to this Website. If you disagree with any part of these Terms and Conditions, then you may not access the Website.

 

In addition, by registering for, accepting, holding and/or using a Ticket you are certifying that you have read, understood and accepted these Terms and Conditions in full and that they form a binding agreement between you as the Ticket Holder, and COP28 (all as defined herein) and that you agree to bring them to the attention of others, if applicable, as set out below.


1. Definitions and Interpretations

In these Terms and Conditions, the following words and phrases shall have the following meanings:

"Ambush Marketing" shall mean an unauthorised intentional or unintentional attempt to: (i) create a false or unauthorised association with COP28 UAE; or (ii) infringe the rights granted by COP28 UAE to its Sponsors and Showcase Participants.

 

 

"Child" or "Children" for the purposes of these Terms and Conditions shall mean any individual that is twelve (12) years of age in the Gregorian calendar, or younger.

 
 

COP28 is the “Event” staged by OSECC (The UAE Office of Special Envoy for Climate Change) at the Venue.

 

“COP28 Website” shall mean the COP28’s official website located at www.cop28.com

 

 

"Data Privacy Policy" means COP28 policy regarding how COP28 gathers, uses, stores, discloses and manages personal information and data. COP28’s Privacy Policy may be found here https://www.cop28.com/en/privacy-policy, as amended from time to time.

 

 

"Date Assign" means the process whereby the Ticket Holder may assign the date when the Ticket Holder intends to use a Ticket to attend the Event.

 

This can be done by reserving a product or service to be used on a specific date in conjunction with the Ticket, for example, by selecting the date the Ticket Holder will attend a specific date of the “Event”.

 

 

 

“Expo City Dubai Site means the site and/or the venue where COP28 will be hosted.

 

COP28 Staff” shall mean all official staff, volunteers and third parties appointed by COP28 including, but not limited to, security and external emergency services that will work at the Event.

 

The Event shall refer to the Conference of Parties 28 hosted by OSECC (The UAE Office of Special Envoy for Climate Change) on behalf of the United Nations Framework Convention on Climate Change (UNFCCC). The event is scheduled to run 30 November 2023 to 12 December 2023. This may be extended until 14 December 2023. 

 

"Force Majeure" means any cause or event beyond COP28 control including, without limitation, Royal bereavement, pandemic, fire, flood, earthquake, strike, lock-out, public health emergency, acts or regulations of government, national calamity or riot, civil commotion, malicious damage, act of God, explosion, war, weather any cause or event arising out of or attributable to terrorism, or any other event (whether of a similar or dissimilar nature) beyond the reasonable control of COP28.

 

"ID" means an original passport or other Government issued, valid and original identification document in English (or with the name, date of birth, country that issued the ID and the expiration date in English) with photograph and proof of age which proves that its holder is a particular person and a particular age.

 

"Person of Determination" means a person with special needs and/or disabilities as identified by Government of Dubai.

 

"Person" means an individual, partnership, firm, corporation, association, trust, unincorporated association or any other legal person.

 

"Sponsors and Showcase Participants" shall mean COP28’s partners, providers, suppliers or other entities that have entered into an agreement with COP28.

 

"Terms and Conditions" means these Visitor Ticket Terms, Conditions and Rules the Data Privacy Policy, and any other rules brought to the attention of a Ticket Holder including on the Website.

 

"Ticket" means evidence of your registration with COP28 which entitles the Ticket Holder admission to the Event. Ticket may also be referred to as a Green Zone Day Pass.

 

"Ticket Holder" means the Person who is possession of a Ticket to attend the Event. 

 

"Venue" shall mean any area within the Expo City Dubai site including, but not limited to, an attraction, a pavilion, a theatre, an entertainment area or any other area designated by COP28 in its sole and absolute discretion that may require a Ticket for access.

 

Access and use of a Venue by the Ticket Holder shall be subject to these Terms and Conditions.

 

 


     2.General Terms, Conditions and Rules.

2.1 All Tickets are issued subject to these Terms and Conditions including, for the avoidance of doubt, the Data Privacy Policy.
2.2 By registering , accepting, holding and/or using a Ticket, a Ticket Holder accepts and agrees to comply with these Terms and Conditions including, for the avoidance of doubt, the Data Privacy Policy.

2.3 The possession and the presentation of a valid and original Ticket and ID is a mandatory condition for a visitor to enter the Venue.

2.4 Fourteen (14) year olds or under must be accompanied by an appropriate responsible adult (who shall be at least eighteen (18) years old) at all times during their visit to the Venue.

2.4.1 For school groups, the student/accompanying adult ratio shall be as follows:
 
   (i)1:5 for Nursery to KG2

   (ii)1:10 for Grade 1 to Grade 7

   (iii)1:15 for Grade 8 to Grade 12

2.5 Ticket Holders have responsibility for complying with these Terms and Conditions. Parent(s) and/or guardians, or a school’s assigned accompanying adults of Ticket Holders that are Children and/or school students on a school trip are responsible for those Children's actions, their conduct and compliance with these Terms and Conditions. In the event the Children access the Venue without accompanying adult or legal guardian, COP28 shall be held harmless and fully discharged from any and all liabilities, claims, obligations, responsibilities, expenses in connection with the Child(ren)’s visit to the Venue to attend the Event.
2.6 COP28 reserves the right to amend these Terms and Conditions at any time, without notice, in its sole and absolute discretion including the Data Privacy Policy and any Ticket Type Terms and Conditions and you agree (including by virtue of your continued use of the Tickets) to be bound by such changes. Current Terms and Conditions shall always be available on the COP28 Website and COP28 therefore recommends that you review these Terms and Conditions at regular intervals.

 

 
2.7 No exchanges or changes of Tickets will be permitted except as specifically set out in these Terms and Conditions or as authorised and facilitated by COP28, in its sole and absolute discretion.

 


   3. Intellectual property Rights

3.1. By purchasing Tickets or holding or using Tickets, Ticket Holders receive no rights to use, license, assign or transfer any intellectual property rights of COP28including, without limitation, the names, trademarks or logos of COP28 . Ticket Holders agree that any unauthorised use, licensing, assignment or transfer or any intellectual property rights of COP28 is a breach of these Terms and Conditions, and may be a criminal offence under applicable laws.

 

 
3.2. Nothing in the Terms and Conditions grants you a right or license to use any trade mark, design right or copyright owned or controlled by COP28 or any other third party except as expressly provided in the Terms and Conditions.
3.3. COP28 owns all the intellectual property rights and materials contained in it’s COP28 Website, and all such rights are reserved. All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in and on the COP28 Website belong to COP28 and/or third parties.
3.4. For the COP28 Website, You must not:

3.4.1. republish material from the COP28 Website (including republication on another COP28 Website);
3.4.2. sell, rent or sub-license material from the COP 28 Website;
3.4.3. show any material from the COP 28 Website in public; and
3.4.4. reproduce, duplicate, copy or otherwise exploit material on this COP 28 Website for a commercial purpose.

   4. Ticket -

COP28 offers Tickets for admission to certain areas of the Venue through the COP28 Website.

   5. Ticket - Price

5.1 Access to the Event is free of charge.

   6. Ticket - Purchase Process

6.1 Tickets are only valid if you register via the COP28 Website.

6.2 COP28 may, at its sole and absolute discretion, cancel a Ticket of anyone whom they believe plans to offer or has offered a Ticket for resale or commercial gain in violation of these Terms and Conditions.

6.3 If Tickets are obtained in any other manner than in accordance with these Terms and Conditions, such Tickets shall be void, together with any other Tickets held by the Ticket Holder, the Ticket Holder shall not be permitted entry to the Venue and Event and the Ticket Holder will be asked to leave the relevant areas of the Venue, notwithstanding any other right that COP28 may have under applicable law.

   7. Date Assigned Tickets

7.1 All tickets to The Event will be date assigned, meaning they can only be used for the date specified on the ticket. No transfer between dates is possible.

7.2 All tickets are subject to single entry, this shall be achieved by scanning of the QR code by an authorized COP28 staff or appointed supplier. Once scanned, the ticket may not be redeemed for future access. No pass outs are permitted.

   8. Ticket Delivery and Collection

8.1 Tickets redeemed directly via the COP28  Website will be issued in electronic format to the registered account of the Ticket Holder, if applicable, or via e-mail to the Ticket Holder.

8.2 COP28 reserves the right to adopt any method of issuance, delivery or collection of the Tickets, for example, collection of Tickets may be at the onsite Ticket box office at the Venue.

8.3 Once Tickets are registered to the Ticket Holder, the Ticket Holder is solely responsible for safeguarding all Tickets.

8.4 If a Ticket has not been received it is the sole responsibility of the Ticket Holder to contact the relevant customer service center of COP28.

8.5 COP28 shall not be obliged to issue any duplicate or replacement Tickets for any lost or misplaced tickets.

8.6 A Ticket Holder shall be solely responsible for checking their Tickets are correct as mistakes cannot necessarily be rectified after registration. If there has been any mistake the Ticket Holder must contact COP28 contact centre without delay.

9.13 Tickets shall remain the property of COP28 at all times.

   9. Tickets - Transfer, Resale or Use for Commercial Gain

9.1 Save for the exception set out in Article 9.2 below, all Tickets are strictly non-transferrable and must not be sold nor advertised for sale.

9.2 A, valid, unused and original single-entry Ticket can be gifted to, transferred to or exchanged by the Ticket Holder with another Person who is known to the Ticket Holder personally such as a friend, family member or colleague. The transfer of a Ticket in this manner shall not contravene Article 10.1 provided that such a transfer takes place without any payment (free of charge) or benefit.

9.3 All Tickets sold, transferred, exchanged or delivered for a fee, benefit or other commercial purpose (unless with COP28’s prior written authorisation which may be withheld or conditioned in its sole and absolute discretion) shall be void, together with any other Tickets held by the Ticket Holder, the Ticket Holder shall not be permitted entry to certain areas of the Venue and a Ticket Holder will be asked to leave the relevant areas of the Venue, notwithstanding any other right that COP28 may have under applicable law.

9.4 All Tickets sold, transferred, exchanged or delivered for a fee, benefit or other commercial purpose (unless with COP28’s prior written authorisation which may be withheld or conditioned in its sole and absolute discretion) shall be void, together with any other Tickets held by the Ticket Holder, the Ticket Holder shall not be permitted entry to certain areas of the Venue and a Ticket Holder will be asked to leave the relevant areas of the Venue, notwithstanding any other right that COP28 may have under applicable law.
 

9.5 Tickets may not be used for advertising, promotion, auctions, fundraising or marketing purposes (including in competitions, contests and sweepstakes) unless with COP28’s prior written authorisation which may be withheld or conditioned in its sole and absolute discretion. Tickets used for advertising, promotion, auctions, fundraising or marketing purposes without the prior written authorisation of COP28 (including in competitions, contests and sweepstakes) shall be void, together with any other Tickets held by the Ticket Holder, the Ticket Holder shall not be permitted entry to certain areas of the Venue without refund, notwithstanding any other right that COP28 may have under applicable law.

   10. The Content

10.1.In these Terms and Conditions “the content” means material (including without limitation text, images, audio material, video material and audio-visual material) submitted to COP28  Websites, for whatever purpose.

10.2. You grant to COP28 a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute the content in any existing or future media. You also grant to COP28 the right to sub-license these rights, and the right to bring an action for infringement of these rights.

10.3. Your content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or COP28 or a third party (in each case under any applicable law). You must not submit any content to the COP28 Website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

10.4. COP28 reserves the right to edit or remove your content or any material submitted to this Website, or stored on COP28 servers, or hosted or published upon this COP28 Website.

   11. Cancellation and Refunds

11.1 Should a Ticket be lost, stolen, counterfeited, not readable, copied, altered, defaced, damaged or obtained in violation of these Terms and Conditions, such Tickets shall be void, together with any other Tickets held by the Ticket Holder, the Ticket Holder shall not be permitted entry to certain areas of the Venue and the Ticket Holder will be asked to leave the relevant areas of the Venue, notwithstanding any other right that COP28 may have under applicable law.

11.2 An event of Force Majeure (as determined solely at COP28’s discretion) may force COP28 to cancel, modify the dates and/or the time of the Event, the Venue and or certain events to be held during the Event. The responsibility and liability of COP28 is expressly excluded in the presence of such event of Force Majeure.

11.3 COP28 shall not be liable for any direct or indirect cost,  including, but not limited to: (i) for cancellation or closure of certain areas of the Venue for whatever reason; (ii) if the Ticket Holder decides not to use the Ticket; (iii) if there is an event of Force Majeure (as determined solely at COP28’sdiscretion); (iv) if the Ticket Holder is refused entry or ejected from certain areas of the Venue for reasons set out in these Terms and Conditions; and/or (v) if Ticket is a lost, deteriorated, damaged, destroyed, stolen or illegible.

   12. Identification and Verification

12.1 Ticket Holders must retain their Tickets at all times while attending certain areas of the Venue. COP28and/or the Venue reserve their right at any time to request a Ticket Holder to present their Tickets upon request by any COP28, or or appointed Suppliers for inspection prior to admission to the relevant areas of the Venue or at any time during the Ticket Holder’s visit to relevant areas of the Venues.

   13. Security Check

13.1 The Ticket Holder consents, as a mandatory condition for access to certain areas of the Venue if indicated, to a security inspection/screening before and/or during the entry to certain areas of the Venue. The security checks may include a body search, bag inspection or inspection of other objects owned and carried by the Ticket Holder. COP28 may request visitors to remove individual items (such as mobile phones, tablets, belts, shoes and coats) from their bags or person to be inspected or screened separately.

13.2 A Ticket Holder who will not consent to a security search or refuses to comply with rules and security notices will be refused entry or required to immediately leave the Venue and/or the relevant areas of the Venue.

13.3 The Ticket Holder acknowledges that COP 28 or appointed suppliers may conduct security searches at any time to ensure safety in the Venue.

Prohibited Items

13.4 Ticket Holders are prohibited from transporting into or near to the Venue the following items, including any items that COP28 or the Venue determine at their sole discretion to be similar:

(i) All types of explosive substances and devices;

(ii) Firearms and weapons (and their parts, replicas);

(iii) Ammunition (including fake items);

(iv) Gas pistols and cartridges;

(v) Detonator capsules, electrical detonators, electrical flammables, detonating cord;

(vi) All controlled substances;

(vii) Daggers, switch blades, knives and other bladed objects;

(viii) Projectiles, including Boomerangs and catapults;

(ix) Offensive weapons or implements such as bayonets, flick knives, extendable batons, sharpened comb, modified belt buckles and loose blades modified into weapons;

(x) Flails and knuckledusters;

(xi) Electroshock equipment/stun guns;

(xii) Alcohol;

(xiii) Personal protection sprays such as CS or pepper sprays;

(xiv) Fireworks, flares and smoke canisters;

(xv) Bicycles, scooters, segways, roller skates and other mobile devices not intended for use by Persons of Determination (only applicable when entering certain areas of the Site and Venues, should they have their own requirements);

(xvi) Radioactive Materials;

(xvii) Corrosive Materials; and

(xviii) Radio or mobile phone jammers, radio scanners, unauthorised radios

COP28 reserves the right to amend this list generally or in respect of any Venue in its sole and absolute discretion.

Restricted Items

13.5 Ticket Holders are restricted from transporting into or near to the Venue, the following any items, including any items that COP28 or the Venue determine at their discretion to be similar:

(i) Professional filming equipment, professional photography equipment with lenses over 30 cms;

(ii) Food and beverage items that are not placed in closed containers (except infant food and beverage, special dietary items, packed lunch, snacks and drinks for school groups);

(iii) Any device with a laser beam/laser pointers or strobe lights;

(iv) Animals (except service and assistance animals e.g guide dogs);

(v) Devices producing excessive noise (vuvuzela, drum, whistle, horns) which may affect comfort and safety;

(vi) Rigid poles and sticks (except walking sticks required for mobility reasons);

(vii) Signage and banners;

(viii) Religious, political, provocative or obscene messaging on clothing;

(ix) Any items intended for use in ambush marketing attempts;

(x) Any items bearing the Expo City Dubai logo, trade name and/or any kind of trademarks that are suspected to be counterfeit;

(xi) Drones and unmanned aerial vehicles; and

(xii) Alcohol

COP28 reserves the right to amend this list generally or in respect of any Venue in its sole and absolute discretion.

13.6 The Ticket Holder acknowledges that if it arrives at the Venue with a prohibited and/or restricted item listed above, or as otherwise determined by COP28 or the Venue, the Ticket Holder will not be entitled to enter the Venue with the prohibited or restricted item.

13.7 Should the Ticket Holder wish to enter the Venue, as the case may be, they must surrender the prohibited and/or restricted item referred to in Article 13.4 and Article 13.5 to the COP28 or Venue . The Ticket Holder acknowledges that COP28 or the Venue will not store any confiscated prohibited or restricted items at the Venue or elsewhere. COP28 and Expo City Dubai Staff may destroy or dispose of the prohibited and/or restricted item and in all cases shall not return any confiscated prohibited or restricted items to the Ticket Holder.

13.8 Any Ticket Holder who is found to be in possession of any prohibited and/or restricted items while in the Venue, as the case may be, may be removed from the Venue, to be decided in COP28 and/or Venue sole and absolute discretion.

13.9 Any Ticket Holder who is in breach of the Restricted Item Policy or the Prohibited Item Policy may be subject to arrest and/or prosecution by the relevant authorities depending on the nature of the prohibited and/or restricted item.

   14. Access To and Use of the Expo City Dubai Site

14.1 The Ticket Holder hereby acknowledges and accepts that due to venue capacity limitations, access flow constraints, health and safety requirements and local law authority enforcement obligations COP28 does not guarantee access to certain areas of the Venue to any Ticket Holder even if the Ticket Holder has a Date Assigned Ticket.

14.2 The Ticket Holder should investigate on the COP28 Website as to the exact opening and closing time of entrance gates and the times suggested by COP28 for entry to certain areas of the Venue, as well as to possible changes of the date, time or other elements relating to the Event including, but not limited to, any Venues, pavilions, restaurants, shops, attractions etc.

14.3 In addition to these Terms and Conditions, the Ticket Holder is required to comply with:

(i) regulations posted at the entrance and inside the Venue including, but not limited to, fire and safety regulations;

(ii) the regulations and rules posted on the COP28 Website;

(iii) any directives that COP28 or the Venue may deem necessary and communicate for technical or organisational reasons; and

(iv) any written or verbal instructions of COP28 or the Venue

14.4 COP28 will ensure that People of Determination will be accommodated at the Event and within the relevant areas of the Venue and shall not be discriminated against in accordance with the federal law of the United Arab Emirates as applied in Dubai.

14.5 If a Ticket Holder holding a single-entry Ticket leaves the relevant area of the Venue for any reason, the same Ticket may not be used to re-enter the relevant area of the Venue, as the case may be. There will be no pass-outs or re-admission of any kind for a single-entry Ticket, unless otherwise permitted by the COP28 or the Venue  in its sole and absolute discretion.

14.6 COP28 reserve the right, without prior notice and without liability or compensation, to (i) change the operating hours and/or dates of the Event; (ii) close any area of the Venue temporarily or permanently, (iii) restrict the number of persons having access to certain areas of the Venue; and/or (iv) suspend and/or cancel any attraction or entertainment program taking place at the Event.

14.7 While walking around the Venue, all Ticket Holders must only use the paths indicated for pedestrian use. It is not permitted for any Ticket Holders to walk, lie, climb or stand on the grass or on any structure at the Venue with the exception of any areas or furniture specifically designated for use by the Ticket Holders for this purpose.

14.8 The Ticket Holder must immediately notify COP28 or the Venue of any incident, accident or emergency or possible incident occurring at the Venue and, if requested to do so, notify any applicable competent authority such as the police, fire or emergency services.

14.9 COP28 reserves the right to refuse re-entry to anyone for the duration of the Event who has previously been removed from the Event in accordance with these Terms and Conditions.

Prohibited and Restricted Items Policy

14.10 Ticket Holders are prohibited and restricted from performing the following behaviors near to or within the Venue:

(i) Any activity that is considered illegal under applicable laws;

(ii) Use of profane, vulgar, offensive or derogatory language or gestures;

(iii) Threatening and abusive behavior including verbal and physical (e.g. chanting, any physical aggressive behavior, any behavior considered to be sexist or racist);

(iv) Gambling, stealing or fraudulent activities;

(v) Taking of illegal substances including illegal drugs;

(vi) Being intoxicated;

(vii) Starting or attempting to start a fire, including violating fire prevention guidelines;

(viii) Making an action which disturbs public morals and norms of conduct, or publicly displaying intimate body parts;

(ix) Damaging any third party or Expo City Dubai assets, equipment, vegetation, cultural sites or other areas within the Expo City Dubai Site;

(x) Violating security and/or access control measures, including attempting to gain entry to areas or Venues not specified on the Ticket and other prohibited areas;

(xi) Conducting a demonstration;

(xii) Throwing or attempting to throw an item/object such as balls, sport balls, rockets, Frisbees or similar objects or projectiles;

(xiii) Utilizing mounts for photo and video equipment including tripods and monopods;

(xiv) Disruptive, distracting, interrupting behaviour or behaving in a manner that may disrupt and/or interfere with activities or events or the comfort of others enjoyment, safety or security;

(xv) Utilising a seat other than that allocated as per a Tickets for an event, performance or show, unless otherwise instructed to do so by COP28 and/or the Venue;

(xvi) Restricting the view of others, and/or deliberately attempting to block the view of others, including standing on seats in seated Venues;

(xvii) Blocking areas that compromise safety, including stairs, steps, passages, accessible areas and exits;

(xviii) Use of any device for the purpose of gaining attention, including any loud speaker, public address or broadcast device not approved by the Venue ;

(xix) Smoking outside designated smoking areas as indicated by signs;

(xx) Consumption of alcohol outside of a licensed area where the product was purchased;

(xxi) Offensive exposure of oneself in public, including wearing inappropriate attire (clothing should not be transparent, indecently exposing parts of the body or displaying offensive pictures or slogans, shorts and skirts shall be of an appropriate length; any form of nudity or swimwear shall be forbidden);

(xxii) Attempting to climb onto fences, balustrades, lighting installations, masts, load bearing structures, sculptures, displays or trees located at the Expo City Dubai Site;

(xxiii) Acting or engaging in actions/activities that could cause crowding, become a safety risk, create a stampede and/or public disturbances;

(xxiv) Distributing, posting, sticking, placing or attempting to post, stick or place any posters, placards, bills, banners, prints, papers, or any advertising or promotional materials, on any building, structure, fence or any area near or within the Expo City Dubai Site, including any parking areas;

(xxv) Unauthorised distribution, hawking, selling or offering or exposing for sale any goods or services, or collecting money or orders for goods or services in any area within or near the Expo City Dubai Site including the parking areas;

(xxvi) Conducting public surveys or opinion polls, soliciting money, unauthorised reporting, collecting donations or subscriptions from members of the public in any areas near or within the Expo City Dubai Site including the parking areas;

(xxvii) Participation in Ambush Marketing activities, selling counterfeit goods or Ticket touting in any area near or within the Expo City Dubai Site;

(xxviii) Images, video and sound recordings with devices such as mobile phone, tablet, photo camera, video camera or audio equipment cannot be used for commercial purposes or for any purpose other than for private and domestic;

(xxix) Taking photos, videos or recording of person(s) without their consent or otherwise in accordance with applicable law; and

(xxx) Conducting entertainment without obtaining the required approvals/licenses.

COP28 reserves the right to amend this list generally or in respect of any Venue in its sole and absolute discretion.

14.11 Any Ticket Holder found engaging in the behaviour stated in Article 13.11 above (to be determined in COP28 sole and absolute discretion) may result in their Tickets being void, together with any other Tickets held by the Ticket Holder, the Ticket Holder shall not be permitted entry to the Venue and the Ticket Holder will be asked to leave the Venue, notwithstanding any other right that COP28 may have under applicable law.

Personal Property

14.12 The Ticket Holder is advised that there is no storage area at the Venue for the Ticket Holder's personal property.

14.13 The Ticket Holder must keep personal belongings with them at all times. Unattended bags or belongings found anywhere in the Venue will be subject to search, removal and/or destruction. Please see the COP28  Website for further information on the lost and found items procedure.

14.14 The Ticket Holder is solely responsible for the safekeeping of their personal property and, as such, COP28, the Venue, its affiliates, their Staff or any other Person involved in the organisation of the Event do not accept any responsibility or liability for any loss, theft or damage of a Ticket Holder's personal property while at the Venue. The Ticket Holder will release COP28, Venue, its affiliates, and any other Persons involved in the organisation of the Event from any liability for any loss or damage to personal property they may suffer in relation to their attendance at the Event.

   15. Filming, Photography and Recordings

15.1 The Ticket Holder consents to be photographed, filmed or taped by COP28, its affiliates, any media appointed by COP28, the National Media Office, Expo City Dubai or their Staff during their visit to the Event.

15.2 The Ticket Holder consents that COP28, , its affiliates, its Sponsors and Showcase Partners, and any media appointed by COP28, the National Media Office or Expo City Dubai shall have the right to broadcast, publish, license and use in any manner whatsoever any live or recorded audio, video, photographs, recordings or any publication or reproduction of the Expo City Dubai which contains the Ticket Holder's image, likeness, actions and statements made of, or at, the Event in any medium or context for any purpose globally without any remuneration or other form of consideration in perpetuity. COP28 and Expo City Dubai and any third parties and anyone acquiring from the Event the right to use such material are not liable to the Ticket Holder in any way for its use.

15.3 Images, video and sound recordings of the Event or the Venue taken by the Ticket Holder with a media capture device such as a mobile phone, tablet, photo camera, video camera, audio equipment or device hereafter existing, cannot be used for any purpose other than for private and domestic purposes. The Ticket Holder may not sell, license, broadcast, publish, or otherwise commercially exploit such material including on social networking website and applications as well as the internet more generally or make it available to third parties for commercial purposes.

15.4 Please be advised that there are certain areas within the Venue that photo, video and/or audio recording is prohibited for security reasons, for example, the security screening area, the restroom facilities and restricted access areas, certain performances etc.

15.5 Please be advised that taking photos or shooting videos of other persons in the United Arab Emirates without their consent may be considered an invasion of their privacy and may lead to prosecution. COP28 hereby notifies all Ticket Holders that not all visitors to the Event and Venues, wish to be photographed, videotaped, recorded or bothered in any manner and any liability incurred for doing so is the Ticket Holder's own.

   16. Transport

16.1 COP28 may supply information regarding the timetables of transport to and from the Venue, but it shall not be considered responsible or liable for any possible inefficiency due to transport issue or delay. The Ticket Holder shall thus be the solely responsible to refer to the timetables of the public transport in order to plan travel to reach the Venue in accordance with their requirements including allowing sufficient time to pass through the security to access the relevant area of the Venue.

   17. Personal Information and Use

17.1 By purchasing, accepting and/or holding a Ticket, you hereby acknowledge that you have read and agree to the contents of COP28’s Data Privacy Policy which is available on the COP28 Website and incorporated into these Terms and Conditions.

17.2 COP28 shall only use, process, store and transfer the personal information and data provided by the Ticket Holders to COP28 strictly in accordance with COP28’s Data Privacy Policy.

17.3 COP28 are committed to ensuring that the Ticket Holder's personal information and data is secure, and, as such, COP28 has put in place suitable procedures to safeguard it, in accordance with applicable data protection laws.

17.4 You acknowledge that COP28 may share your personal information and data with relevant authorities, such as police and Expo City Dubai, for safety and security reasons, which may include security checks on the names of the Ticket Holders. COP28 reserves the right to refuse access to any Ticket Holder who has been convicted of an offence which, in COP28’s sole and absolute discretion, is likely to affect the safety or enjoyment of the visitors.

17.5 CCTV is in use in the Venue for the purpose of crime prevention and public safety. The Ticket Holder consents that COP28 may use such images for the purpose of maintaining and investigating safety and security at the Venue. Such CCTV recording shall be used, stored, transferred and destroyed in accordance with applicable laws.

   18. Liability

18.1 Ticket Holders acknowledge and accept the risks and dangers inherent in attending the Event. The Ticket Holder is required to pay the maximum attention and exert the maximum due care and prudence in and near the Venue.

18.2 A Ticket Holder acknowledges and accepts it is responsible for his or her own safety and for the safety of any accompanying Children while attending the Event, at all times, including during workshops and shows.

18.3 Admission to the Event, including any Venue, is at the Ticket Holder's sole risk. Neither COP28, Expo City Dubai, its affiliates, or any other person involved in the organisation of the Event accept responsibility or liability for any loss, injury or damage to person sustained within the Venue. COP28 does not exclude liability for death or personal injury caused by the negligence of COP28.

18.4 Personal arrangements including travel, accommodation or hospitality relating to attendance at the Event which have been arranged by or on behalf of the Ticket Holder are at the Ticket Holder's own risk.

18.5 Neither COP28, Expo City Dubai, its affiliates, their Staff or any other person involved in the organisation of the Event shall be responsible or liable to the Ticket Holder for any failure to perform any obligation under these Terms and Conditions to the extent that the failure is cause by an event of Force Majeure.

18.6 Neither COP28, Expo City Dubai, its affiliates, their Staff or any other person involved in the organisation of the Event shall be responsible or liable to the Ticket Holder for any incidental and indirect losses or damages including, but not limited to, loss of employment, goodwill or profit and/or travel, parking or accommodation expenses.

18.7 COP28, Expo City Dubai, its affiliates, their Staff or any other person involved in the organisation of the Event shall not be liable for any breach by the Ticket Holder of these Terms and Conditions.

18.8 If a Ticket Holder r causes COP28 to incur loss, damage, costs or expense due to breach of these Terms and Conditions or otherwise, then the Ticket Holder shall be liable to COp28 for this.

18.9 If a Ticket Holder causes a third party to incur loss, damage, costs or expenses due to its breach of these Terms and Conditions or otherwise, then the Ticket Holder shall be liable to the third party for this.

18.10 Except as required by law, COP28 and its affiliates or any other Person involved in the organization of the Event shall have no other liability to a Ticket Holder.

18.11 In no event shall COP28nor any of its officers, directors and employees be liable to you for anything arising out or any way connected with your use of the COP28 Website, whether such liability is under contract, tort or otherwise, and COP28, including but not limited to its officers, directors and employees shall not be liable for any direct or indirect, consequential or special liability arising out of or in any way connected to your use of the Website.

18.12 You hereby agree to indemnify to the fullest COP28 from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including attorney’s fees) arising out of or in any way related to your breach of any provisions of the Terms and Conditions.

   19. Breach of these Terms and Conditions

19.1 If a Ticket Holder in the sole discretion of COP28 breaches these Terms and Conditions, then COP28 reserves the right to void any Tickets, together with any other Tickets held by the Ticket Holder, the Ticket Holder shall not be permitted entry to the Venue and/or a Ticket Holder will be asked to leave the notwithstanding any other right that COP28 may have under applicable law. The Ticket Holder agrees that COP28 may void the Tickets without the prior order of any court.

19.2 If the Ticket Holder breaches these Terms and Conditions, COP28 may also pass information concerning the Ticket Holder, as the case may be, to the relevant law enforcement agencies, and/or who may have an interest in the management of the Event. They may use this information to take action against a Ticket Holder in relation to its breach.

19.3 Any Ticket obtained or used in breach of these Terms and Conditions shall be void and all rights conferred or evidenced by such Ticket shall be nullified.

19.4 Any Person seeking to use a Ticket obtained in breach of these Terms and Conditions in order to gain entry to the Venue may be considered to be a trespasser and may be liable to be refused entrance, ejected from the Venue and/or liable for legal action, including criminal prosecution.

19.5 COP28 may terminate or suspend access to the Website immediately, without prior notice or liability, for any reasons whatsoever, including without limitation your breach of the Terms and Conditions. All provisions of the Terms and Conditions by their nature shall survive termination, including without limitation, ownership provisions, warranty disclaimers, indemnity and limitation of liability.

   20. General

20.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the emirate of Dubai. Any dispute or claim arising out of or in relation to these Terms and Conditions, including any transaction with COP28, shall be finally settled by the courts of Dubai.

20.2 If COP28 delays or fails to exercise a right or remedy or enforce any of these Terms and Conditions or those available by applicable law it shall not mean that COP28 has waived its right to do so. A waiver of a breach of any of the Terms and Conditions or of a default under these Terms and Conditions does not constitute a waiver of any other breach or default and shall not affect the other terms of the Terms and Conditions.

20.3 The Website is  provided “as is” and COP28 makes no express or implied representations or warranties of any kind, related to the materials contained on the Website. Without prejudice to the generality of the foregoing paragraph, COP28 does not warrant that the Website will be constantly available, or available at all; or the information on this website is complete, true, accurate or non-misleading.

20.4 These Terms and Conditions have been drafted in English only. A translation in Arabic is available on request.

20.5 COP28 reserves the right to amend these Terms and Conditions at any time and such amendment is effective from the date it is posted on the Website. By using the Website, you are expected to review the Terms and Conditions on a regular basis to ensure that you understand all the terms and conditions governing the use of the Website.

20.6 COP28 shall have the right to assign, transfer or sub-contract its rights and obligations stipulated under the present Terms and Conditions without any notification or consent required. You may not assign, transfer or sub-contract any of your rights or obligations stipulated under the Terms and Conditions.

20.7 These Terms and Conditions including any disclaimer contained on this Website, constitute the entire agreement between you and COP28 in relation to your use of the Website, and supersede all previous agreements in respect of your use of this Website.

20.8 If any part of these Terms and Conditions is deemed by a court (or by the arbitrator) to be unenforceable, the remainder of the Terms and Conditions shall not be affected.
